The Gauhati High Court has stayed the Government' order transferring Dr Kh Pramodkumar as project director of MACS and degrading the present project director of MACS Dr TR Kom as deputy director.
Justice TNK Singh, in his Imphal Bench sitting today, passed the interim order following a writ petition filed by TR Kom challenging the State's order issued by Under Secretary Health on November 16.Incidentally, Dr Kh Pramodkumar was holding the post PD before TR Kom took over it.
Appearing on behalf of TR Kom, Serto put before the Court that under the Letter of Understanding (LOU) prepared by the Ministry of Health, the post of project director should not be transferred for at least three years.
Dr TR Kom was appointed MACS PD only on September this year, he said.
Contending that the transfer order has violated the LOU, advocate Serto asserted that his client should continue as MACS PD till he completes three years.
While staying the November 16 order transferring Dr Pramodkumar as MACS PD, the Court asked the respondents to give their replies on the matter within a week.
The respondents listed in the case are the State represented by Principal Secretary (Health and Family Welfare), Union Secretary of the same Department, Additional Secretary and Director General of NACO and Dr Kh Pramodkumar.
