SC trashes Andro MLA's SLP against election petition

The Supreme Court has dismissed a Special Leave Petition (SLP) hied by Andro MLA Thounaojam Shyamkumar seeking dismissal of the election petition filed in the High Court of Manipur by Lourembam Sanjoy, who was fielded by the NPP in the 2022 assembly election, and his brother Lourembam Sanjit.
MLA Shyamkumar filed the SLP in the Supreme Court after the High Court, on October 13, rejected his earlier plea seeking dismissal of the same petition filed by his opponent in the 12th Manipur Legislative Assembly Election, 2022.The election petition filed by Lourembam Sanjoy and his younger brother prayed for declaring the election of Shyamkumar null and void on the grounds of false statements and concealment of information in the election affidavit pertaining to criminal cases, non-disclosure of the agricultural land recorded in the name of his spouse by mentioning it as residential building with four floor pucca structure, as well as alleging booth capturing at several polling stations and casting votes in the name of deceased voters, which amounted to corrupt practices.
Countering the election petition, MLA Shyamkumar hied his SLP seeking its dismissal stating that the material facts pleaded in the election petition are frivolous, concocted, a jealous petition.
The acting chief justice of the High Court MV Muralidaran, after hearing the arguments presented by the respective counsels, had dismissed the petition.
Meanwhile, during the hearing of the case held on Wednesday, a Supreme Court bench observed, "We are not inclined to entertain the Special Leave Petition under Article 136 of the Constitution of India,"
and dismissed the petition.
