Speaker, BJP blot to parliamentary democracy: O Joy

Imphal, September 29 2021: Manipur Legislative Assembly speaker Y Khemchand and BJP have not only degraded the parliamentary system of democracy but also violated the Constitution of India, alleged Manipur Pradesh Congress Committee spokesperson and ex-opposition leader/minister O Joy.

Addressing a press meet held at his Kakwa residence here on Wednesday, O Joy said that during a meeting of BJP Manipur Pradesh which was attended by key members of the party, speaker Y Khemchand not only displayed preferential treatment towards the party but also voiced his role as a party member.

The speaker also made statement claiming that it was the first time attending a flag hoisting function of BJP, despite having numerous responsibilities as a speaker.

His action could be considered as a violation of the Constitution and also an act of mockery towards the parliamentary system of democracy.

"Speaker Khemchand neither has resigned nor ceased from his role as the speaker of Manipur Legislative Assembly.

He has also not been removed from the post by a resolution of the majority members.

As such, it is unfortunate that he and BJP seem to have forgotten he (Khemchand) still holds the responsibility of a speaker till end of term of the 11th Manipur Legislative Assembly," he remarked.

Joy continued: "The office of Speaker should be dignified, independent and impartial.

However, it is questionable whether Khemchand is maintaining the dignity of the speaker's office, considering his attendance in a programme/function of a political party.

This has also raised another question whether BJP Manipur Pradesh respects the seat of the Speaker, which symbolizes the parliamentary system of democracy.

"To summon or prorogue a session of the Legislative Assembly, the CM should submit a written request of the same to the Governor.

For a speaker to boldly say that the final session of the 11th Manipur Legislative Assembly has been held is honestly an act of disrespecting the Constitution.

Article 174 of the India Constitution empowers the Governor with regard to summoning or proroguing a session of a legislative assembly.

Thus, speaker Khemchand does not have the power to summon or prologue a session.

If the term of 11th Manipur Legislative Assembly continues smoothly, the gap between two sessions should not be more than six months, as per Article 174 (1).Taking this into consideration, the last session concluded on August 24 and as such, the next session should he held on February 23 next year.

"However, if a year has passed, the Governor needs to give an address and as such, a session should be held in December.

Thus, it is unfortunate for a speaker like Khemchand to make such undemocratic statement, which has been further worsened by his attendance in the programme/function of a political party, while also showcasing BJP's disrespect of the constitution", the spokesperson said.

Joy then urged those holding the posts of speaker and deputy speaker to uphold the Constitution and the parliamentary system of democracy.
