Juvenile accused sent to special home

Imphal, April 06 2017: The Juvenile Justice Board, Imphal East passed an order on April 3 to keep an underaged child in Conflict with Law in a special home for a period of one year while his father has been fined Rs 5000 payable within two months.

The order was passed in connection with JJB enquiry case number 2 of 2016 with Ref FIR number 19 (10) 2014 Women Police Station, Imphal East under Section 6 of Prevention of Children from Sexual Offence (POCSO) Act.

The board perused the record and heard the counsel for the CCL and the Government counsel on April 3 before the final order was passed against the CCL.

Counsel for the CCL submitted that the offence was committed due to extreme tender age and ignorance and the child had already stayed at an observation home for about 4 months in connection with the same case.

The incident happened in 2014 and the juvenile has now been completely reformed and rehabilitated.

It was also submitted that the Juvenile is married and is earning his livelihood by doing daily manual labour and looking after his wife.

Further detention of the CCL will cause great harm to the interest of the juvenile.

The Government counsel, on the other hand, submitted that considering the gravity and heinous nature of the offence, it is necessary to keep the CCL in an 'institution' for at least some period of time and prayed for imposition of fine.

Local Process Outsourcing (LPO) of the board in his report submitted that the parents of the CCL are uneducated and farmers by profession.

The CCL gave up education in early childhood and was not properly guided by his parents because of the poor economic condition of the family.

The CCL committed the offence by threatening his cousin and it would take some more time to reform the CCL and become a law abiding citizen, said the LPO.

After hearing counsels of both the parties, the JJB passed an order stating that the CCL should be kept in a special home for a period of one year.

The period of stay already undergone by the CCL in the observation home will be deducted.

As such, the CCL would be kept in the special home till August 2, 2017.The JJB also directed the SP of Special Home, Takyelpat to take up necessary measures for reformation and rehabilitation of the CCL and also to provide vocational training to the CCL suitable to his talents and inclination.

The Board further imposed a fine of Rs 5000 and the same should be paid by his father within two months and the said amount should be given to the victim as compensation.

It may be mentioned that the CCL was arrested by Imphal East women police personnel after a complaint was lodged by the father of the victim on October 1, 2014 that on September 25 the CCL raped a minor girl.
