10 years RI for drug peddler

The Court of Special Judge NDPS on Thursday sentenced a 40 year old convict in a drug related case to 10 years of rigorous imprisonment.
Md Abdul Kalam, s/o Abdul Salam of Churachandpur Old Bazaar who was convicted on August 6 was arrested by City police along with contraband drug items from the eastern side of Naga Nullah near Kasturi Bridge on February 22, 2015 .
The convict was produced before the Court for sentence hearing from Manipur Central Jail at Sajiwa.
During the hearing, the defence counsel submitted that the convict is a first time offender and has no other criminal record.
It was further submitted that the convict is a drug addict and prayed for a minimum sentence.
The Special PP M Raichand, on the other hand, prayed for maximum punishment.
The Court after hearing the submission of Special PP and defence counsel and on perusal of the materials on record sentenced the convict to 10 years of rigorous imprisonment and also imposed a fine of Rs 1 lakh under Section 21( c) of NDPS Act.
The Court further sentenced the convict to undergo another rigorous imprisonment of 5 years along with another fine amounting Rs 50,000 under Section 22 ( b) of ND&PS Act.
The terms of imprisonment shall run concurrently, the Court ruled.
The fine amounting Rs 1,50,000 should be paid within six months and in default of payment of the fine the convict has to undergo another one year of rigorous imprisonment.
The period of time which the convict had undergone in the judicial custody during the investigation and trial of the case is set off from the sentence announced today.
