The Imphal bench of the Gauhati High Court has admitted a petition filed by Karam Thamarjit seeking the quashing of the election of Md Allauddin Khan from the State Assembly.
Allauddin Khan was elected from the Keirao Assembly Constituency on a Congress ticket beating K Thamarjit of the MSCP by one vote.
Talking to The Sangai Express, a well placed source said that the High Court besides admitting the petition for hearing has issued order to Allauddin to appear before it on June 8 and to submit written statements if any.
The petition was filed under Section 80-A read with Section 81 of the Representation of Peoples Act, 1951 challenging the election of Allauddin Khan from Keirao Assembly Constituency, said the source.
While submitting the petition, Thamarjit also submitted a number of annexures to give weightage to his contention to declare the election of Allauddin as void, said the source further.
Admitting the petition for further hearing, Justice BD Agarwal also directed the Returning Officer to preserve all the election related papers, documents, instruments including Electronic Voting Machines until further orders.
The election in Keirao was mired in controversy after some miscreants snatched some EVMs from a polling booth on election day.
Repoll was thereafter ordered at the polling station where the incident took place.
Allauddin incidentally has been inducted in the Ministry.
