The Supreme Court making a ruling on a case concerning seniority issue in the Regional Institute of Medical Sciences (RIMS) has asked RIMS authorities to pay Rs 10,000 as legal fee to one Dr S Bhagyabati Devi, who is an Associate Profession in the same institute.
justices SB Sinha and Markandey Katju passed the order on May 17 following a civil appeal arising out of a special leave petition (SLP) filed by RIMS authorities and one by Dr taruni Ngangbam also an Associate Professor in RIMS.
The apex court dismissed the appeal.
The case pertains to seniority list between Dr Bhagyabati Devi and Dr Taruni with the former moving imphal bench of gauhati high Court questioning seniority assigned to Dr Taruni with the plea that she (Taruni) had never held any teaching post while acting as Medical Officer (SPM).
Dr Bhagyabati further raised why she was not entitled to promotion as Assistant Professor.
having heard both parties, the High Court (single bench) in a verdict in 2004 insisted that both be promoted to Associate professors with Dr Bhagyabati to be treated as senior of the two.
Aggrieved with the HC ruling, RIMS authorities and Dr Taruni filed writ appeals before the Division bench of the High Court that upheld the single bench order favouring Dr Bhagyabati.
However, the matter reached the Supreme Court in 2005 who also decreed on the line of the High Court.
