FAA instructs CJM

The First Appellate Authority, District and Sessions Division, Imphal West has instructed the Chief Judicial Magistrate (CJM) Imphal West to furnish information sought by an individual under the Right to Information (RTI) Act.
One Aklham Kamisanar of Achanbigei, Imphal East filed two applications on May 21 and June 12 last to the Imphal West CJM who is also the SPIO seeking certain information.
However, the CJM/SPIO rejected the RTI applications on the ground, that the RTI applicant was seeking the information as certified copy but for issuing certified copy there exists a rule for obtaining certified copy under the Gauhati High Court Civil/Criminal Rules and orders which is still applicable to the Courts of Manipur.
Aggrieved by the rejection of his RTI applications, Akham Kamisanar filed two appeals at the First Appellate Authority.
The Court of the First Appellate Authority studied the appeals on January 30 this year and instructed the SPIO/CJM Imphal West to furnish the information sought by the application within seven days.
The RTI application was seeking certified copies of the tables of fees/requisite stamps and folios etc, accompanied by time limits in respect of seeking and finishing of Courts' and tribunals' orders, proceedings and documents.
Kamisanar was also seeking certified copy of the general rules which are being adopted by the High Court of Manipur or of the rules which are being made by the High Court of Manipur in connection with all Courts and tribunals in the State of Manipur.
After studying the applicant's appeals, the First Appellate Authority, District and Sessions Division, Imphal West, citing an office memorandum issued on October 6, 2015 by the Ministry of Personnel, PG and Pension, Department of Personnel and Training, Government of India, instructed the SPIO/CJM Imphal West that if an application requested for certi fied copies of documents/records, the concerned authority should supply the information as 'true copy' of the documents/records.
