Final hearing of inquiry into Thoithoi's killing on May 19

Sessions Court Imphal West today fixed May 19 for the final hearing of the judicial inquiry into the killing of Thangjam Thoithoi of Thangmeiband Sinam Leikai in an alleged encounter with a combined team of Imphal West commando and 18 Sikh Regiment at the junction of Mayai Lambi and Chandranadi road on January 14, 2012 .
Mother of the deceased, Th Apabi had filed a writ petition in 2015 against Union of India and four others as respondents.
The petition had prayed for directing the Sessions Court to carry out a judicial inquiry into the killing.
The respondents include Union of India through Defense Secretary, Ministry of Defense, Commanding Officer, 18 Sikh Regiment C/O 99 APO, State of Manipur through Principal Secretary (Home), DGP Manipur and SP Imphal West.
A division bench of High Court of Manipur comprising of the then Chief Justice LK Mohapatra and Justice Kotiswar on September 7, 2015 had passed an order directing the Sessions Court to conduct an inquiry into the allegation in the writ petition and submit a report within six months.
As per the direction, Sessions Judge Imphal West has recorded submission of the petitioner on February 1, 2016 and recorded statement of five witnesses from the petitioner's side and six witnesses from the respondents' side so far.
According to the writ petition, National Human Rights Commission had asked the State Govememnt to show cause as to why it should not recommend relief to the next of kin of the deceased.
After holding a three-day sitting in Imphal from October 23, 2013, the Commission had also recommended that the State Government should pay Rs 5 lakh as relief to the next of kin of the deceased and a proof of payment would be expected by December 19, 2013 which the petitioner during the filing of the writ petition denied any kind of relief/com-pensation from the State Government.
