Court summons INC candidate

The Court of Chief Judicial Magistrate (CJM), Imphal West has issued a summon to Congress candidate in Wangkhei AC Okram Henry returnable by February 23 .
The summon was issued on February 4 regarding a complaint filed against O Henry by Asian Bulls Construction and Developers Limited before the Court under Negotiable Instruments Act and Section 420 of Indian Penal Code.
Acting on the complaint, the Court registered a case and listed Okram Henry s/o late Lukhoi of Mantripukhri as respondent.
The complaint accused O Henry of harbouring malicious intention to cheat the complainant of its legitimate dues.
The petition filed by the complainant alleged that the accused signed two agreements with the company on August 21, 2013 and November 18, 2013 wherein it was agreed that the accused would take a loan of Rs five crore and another Rs 1 crore for construction of Kaspar Mall at Mantripukhri, Imphal East.
As per the terms and conditions of the agreements, the accused allegedly took loans from the company.
The complaint further mentioned that an amount of Rs 42,27,551 out of the total payable interest amount has been recovered till date.
The accused issued a cheque of Rs 10 lakh on January 2, 2017 to discharge his liability partly but the cheque was not honoured by the concerned bank.
Subsequently, the complainant sent a legal notice to the accused on January 7 this year under Negotiable Instruments Act 1881 through registered post.
As the legal notice failed to elicit any response, the complainant (company) prayed before the Court to summon, prosecute and punish the accused in accordance to relevant laws.
