'Extrajudicial killing of Sanajit': Next hearing fixed on October 16

Regarding alleged extra judicial killing of Pheiroijam Sanajit on the intervening night of May 30 and 31, 2004, at Khurkhul Phumlou, the Chief Judicial Magistrate Imphal West has issued notice to informant victim families, Extra Judicial Execution Victim Families Association Manipur (EEVFAM); Ministry of Defense; Head of Department of the accused and CBI for the next hearing on October 16, 2020 .
The final report of the CBI was submitted by Harish Goel, Inspector CBI in September last before the Court of Chief Judicial Magistrate along with a prayer for passing appropriate order on the ground that the Central Government, particularly the Ministry of Defense denied to accord prosecution sanction under Section 197 CrPC and Section 6 of AFSPA against the 4 accused Army personnel belonging to 19 Rajput ( Bikaner) - Major Girish Nair (now retd) of Indore, then Captain Rahul Bal Mishra of Ahmadabad, then Havildar Ranbeer Singh of Haryana and then Sepoy Abhay Pratap Singh of Uttar Pradesh.
It was revealed during the CBI investigation that the accused personnel are liable for prosecution under Section 302/ 342/201 and 34 IPC.
It is also submitted in the closure report that some of the Rajput (Bikaner) Army personnel namely Subedar Dalchand, then Subedar Rohitash Verma have reportedly expired and therefore no action was recommended against them.
The report also mentioned that a case was registered before Sekmai Police Station by the then Naik Subedar Surendar Pal of 19 Rajput Rifle that a troop of Army personnel was attacked from different direction in Senjam Chirang along the Khurkhul Phumlou Road on the intervening night of May 30 and 31, 2004, and in exchanged of fire an unidentified underground cadre was killed.
During an investigation it was found that the wife of the deceased filed a writ petition before the then Guwahati High Court ( Imphal Branch), stating that his husband was taken away by a team of Army personnel of 19 Rajput Rifles on May 31, 2004 at around 1 am from their house without issuing an arrest memo.
On further investigation, it has come to light that another FIR case was registered at Lamlai Police by the elder brother of the victim, mentioning that Sanajit was picked up from their residence by 19 Rajput Rifle personnel.
