The Gauhati High Court has served notices to the union of India and State of Manipur regarding the alleged stage managed killing of one Thangjam Binoy Singh of Lamding Khumanthem Leikai in Thoubal district in March last year.
According to information conveyed by Human Rights Law network (Manipur), the court notices are based on a writ petition filed by the mother of the deceased - Th Ibempishak Devi - before a Division Bench comprising of Justices M Binoykumar and T Nandakumar.
The notices are returnable within six weeks.
Advocate Meihoubam Rakesh appeared on behalf of the petitioner.
The advocate contended before the Court that Th Binoy (19) was picked up on the intervening night of March 6-7 from his residence by personnel of 28 Assam Rifles without issuing arrest memo.
The 19 year old youth was discovered slain at Thoubal-Charangpat Road near Kshetri Leikai crossing, said the network while claiming that in the said �fake encounter� the AR men also gunned down two more persons named as Khumanthem Somorendro Singh and Md Azad Khan.
The investigation carried out by the Thoubal district SP had found the victim to be innocent and subsequently recommended payment of ex-gratia based on which the State Govt had complied with financial assistance of Rs 1 lac to the deceased family on February 28 this year.
Quoting the inquiry report as �unjustified manner� of the Assam Rifles personnel leading to the death of Binoy the Law body informed of the relief sought in the petition also include fixing responsibility for killing the youth after arrest, to punish the culprits and besides payment of adequate compensation.
