Seven years for rape convict

Gaiphulshillu Golmei, District and Session Judge, Imphal East, sentenced a 40 year old rape convict, identified as one Yumnam Bhorot to 7 years in prison, under section 4 of POCSO Act, for sexually assaulting a mentally unstable minor victim on April 6, 2015.The order was announced on February 25 after the sentence hearing was held before the Court against Yumnam Bhorot alias Naocha s/o Apabi of Sawombung, near Biramangol College, (presently staying at a rented house at Pangei Yangdong) who was convicted on February 18.The sentence was kept reserved from December 19 last year.
During the hearing of the case, the Court heard the submission of M Bishambhor, APP for the State, and Advocate Samom Ibjen, Legal Aid counsel for the convict.
The APP submitted that Yumnam Bhorot alias Naocha was convicted for sexually assaulting a minor girl who is also an epileptic and prayed for punishing the convict to the maximum degree.
On the other hand, the defense counsel prayed for punishing the convict to a lesser degree and pointed out that no allegations, except the present one, has been made against the convict, who is not a habitual offender, so far and also prayed for setting aside the period his judicial custody from the sentence.
After hearing both parties, the Court sentenced Yumnam Bhorot to 7 years in jail and ordered the period which he has already has spent in judicial custody to be set aside from the sentence ordered.
It may be mentioned that the father of the minor victim lodged a complaint to the OC Women PS, stating that on April 6, 2015, at around 1 pm, his daughter was sexually assaulted by the convict inside his rented room after he (convict) asked the victim to bring a cup of tea inside the room.
The father reported that the victim girl had gone to Pangei in search of her mother and while she was sitting near a signboard at the bazaar, the convict had persuaded the victim to got to his rented room on the pretext of having a cup of tea.
The trial against the convict began after a charge sheet was submitted before the Court by then OC, Women PS, Imphal East on December 14, 2015 .
