At a time when the Okram Ibobi Singh Government is facing a serious crisis in the face of tough stand-off between it and the NSCN (I-M) and the total blockade on the National Highways, the State has been asked to open a sealed cover of a Departmental Promotion Committee (DPC) proceedings for appointing the DGP of the State Police Department.
As the sealed cover was in respect of the DPC proceedings of IPS officer C Peter Ngahanyui, the fate of the current DGP Yumnam Joykumar Singh (1976 IPS batch) and senior IPS officer C Peter (1975, IPS batch) hangs in a balance over the question of who should occupy the post of DGP.
Whoever is best in terms of all standing criteria will become the State police chief.
Acting on an Execution Petition (EP) filed by C Peter, the Guwahati bench of the Central Administrative Tribunal (Cat) on Monday asked the Government respondents to open the sealed cover and implement the recommendation made by the earlier DPC with all consequential benefits.
Advocate Moiranthem Gunedhor Singh, who appeared on behalf of Peter, a Manipur-Tripura IPS cadre of 1975 batch, said the EP was filed with a prayer to declare the results of the DPC held on March 19 this year and to open the seal cover.
Following a previous Cat ruling, the Government conducted the DPC after which Joykumar was appointed as DGP while the findings in respect of Peter was kept under seal as a departmental inquiry against him on certain financial matter was pending, Gunedhor said.
Peeved with the development, Peter filed the EP to execute an earlier order passed by the Cat asking the Govt respondents to conclude the departmental inquiry proceedings within sixty days, Gunedhor said.
In their division bench sitting, Judicial member Mukesh Kumar Gupta and administrative member Madan Kumar Chaturvedi of the Cat maintained "In the result, EP Nos 2 and 3 of 2010 are allowed." "Since final order on the disciplinary proceedings initiated vide memorandum dated July 18, 2007 has not been passed within 60 days of the said order in any case by April 26, 2010, time limit as extended vide order April 12, 2010, the said disciplinary proceedings stand abated.
"Respondents are accordingly directed to open the sealed cover and give effect to recommendation made by the DPC with all consequential benefits," the Cat ruled.
The State represented by the Chief Secy, Secretary/Commissioner (Home), Principal Secretary (DP), DGP, Secretary (MHA) and Chairman (UPSC) are the listed respondents in the EP case.
