The Imphal bench of Gauhati High Court has stayed a Government order pertaining to issuance of instruction to banking establishment for halt on payment of pension to retired headmasters who had served in State run high schools.
Justice MBL Singh passed the interim stay on August 25 following a writ petition filed by two retired headmasters.
The impromptu freezing of the pension incentives enjoyable by the retired headmasters was ordered without the authority of the law, said advocate N Umakanta Singh, counsel on behalf of the two petitioners.
Presenting the case anecdotes, the counsel said Commissioner (Education-S) on April 21 issued an order superseding an earlier decree of the Education Director (S) regarding increment of pay scale of the retired headmasters accountable from May 5, 2003.Consequently, the Commissioner (Finance) on April 25, 2005 passed another order halting payment of pension to all the retired headmasters with the banks conveyed of the Govt prohibition on the same day of the latest order, Umakanta maintained.
