With the appointment of District and Sessions Judge, Manipur East, M Binoykumar as a Judge of the Gauhati High Court, the number of Jud-ges and Magistrates posts lying vacant in the State judiciary has increased to 8.The vacant posts include one District and Sessions Judge and Additional District and Sessions Judge, Manipur East, five MJS Grade III posts, Judicial Magistrate, first class of Ukhrul, Tamenglong, Churachandpur, Kangpokpi and Jiribam and Transport Magistrate.
Despite the order of the Gauhati High Court to fill up two of the vacant posts, the State Government has been sleeping over the matter, said a source adding that the posts that have been asked to be filled up include the post of one MJS Grade I and one MJS Grade II.
Following a DPC, the Gauhati High Court had recommended the name of an Advocate for the post of MJS Grade I (Addl District and Sessions Judge, Manipur East) which has been lying vacant since 1999.The recommendation of this particular Advocate was however challenged by one person, however no stay was granted and the same was dismissed on January 31, last year, said the source.
The complainant then filed another writ appeal but the same was also rejected on May 11 this year.
While dismissing the writ appeal, the Court had directed the State Govt to appoint the said Advocate as MJS Grade I within three weeks.
The State Govt is yet to comply with the order of the High Court though the Supreme Court had earlier decreed that all vacancies should be filled up in the subordinate Courts.
Meanwhile the person challenging the appointment of the chosen Advocate again filed a Special Leave Petition challenging the order which dismissed his appeal.
