Rapist sentenced to 10 years RI

Imphal, June 29 2016: Mongjam Phulendro (60) of Mayang Imphal Thongkhong Awang Leikai, who has been convicted in the rape case of his own daughter-in-law, has been sentenced to 10 years rigorous imprisonment today.

During the sentence hearing held today, the special public prosecutor and defence counsel made their submissions before the Sessions Court, Imphal West Judge Maibam Manojkumar.

After perusing the arguments of both the sides, the Court sentenced Phulendro to 10 years rigorous imprisonment along with imposition of a fine of Rs 50,000 .

The Court judgement said that the said amount would be handed over to the rape survivor as compensation.

In case the convict fails to deposit the amount to the Court, he will undergo six months simple imprisonment.

A copy of the judgment will be sent to Manipur State Legal Services Authority to enable the victim to receive the compensation under Section 357-A of Code of Criminal Procedure.

The Court also recommended to provide a compen- sation of Rs 2 lakh under Union Ministry of Women and Child Development's Financial Assistance and Support Service to Victim of Rape: A Scheme for Retrospective Justice.

In this regard, a copy of the judgment will be sent to Imphal West DC, who is also the Chairman of Imphal West District Criminal Injuries Relief and Rehabilitation Board.

It may be mentioned that Phulendro was convicted under Section 376 IPC (rape) yesterday.

The incident of rape happened on March 28, 2012 .

At around 3 pm on the day, Phulendro got inside the bedroom of his 33-year-old daughter-in-law, who was sleeping there with her children, and raped her.

The victim's husband was not present in the house when the incident happened.

The mother of two lodged a complaint with Mayang Imphal police station at around 8.30 pm the same day.

The police station took up an FIR bearing number 22 (3) 2012 under Section 376 and arrested Phulendro immediately.

The police later submitted charge sheets against Phu-lendro and his daughter Premi under Section 376 IPC and Section 201 IPC respectively to erstwhile Sessions Court Manipur East.

The charges were framed in the Court against the duo on February 18, 2013.Later, the case was shifted to Sessions Court, Imphal West on January 2, 2016 .

The prosecution produced 16 witnesses, exhibited 22 evidence materials and five MO before the Court during the trial of the case.
