SC disposes MLA Loken's appeal

The Supreme Court of India has disposed the appeal of Wangoi MLA Khuraijam Loken and directed the parties involved to pursue their remedies at the High Court of Manipur.
Hearing of the appeal with Khuraijam Loken as appellant and Oinam Lukhoi Singh and others as respondents was conducted by a two-member bench of the apex court comprising justice Surya Kant and justice KV Biswanathan on Saturday.
The bench heard statements from both the sides and later gave approval for rectification of the election petition filed by respondent No 1 (Oinam Lukhoi) by removing Para 34 .
The bench also ruled that the allegation of corrupt practices against the appellant should be withdrawn if framed by the high court.
It also said that the high court may conduct further hearing on exact evidences of corrupt practices against the appellant as mentioned in statement of respondent No 1 and the court may re-frame corrupt practices against the appellant if found to be true.
If no evidence of corrupt practices against the appellant is found even after withdrawal of Para 34, the high court need not re-frame the corruption charge, the bench said and accordingly disposed the appeal.
In view of the above statement, the court vacated the interim stay made during the proceeding of election petition No 19 of 2022 on July 6, 2023 .
Parties involved may pursue their remedies at the high court, the bench ruled and disposed the relevant pending interlocutory application.
