Court directs to hold written test for SI, Jamandar

Imphal, February 09, 2011: The Gauhati High Court, Imphal Bench has directed the state DGP to hold another written test for 165 candidates who could not appear in the written test for recruitment of Sub-Inspectors and Jamandars conducted on January 2, 2011. The court directed the DGP in response to a writ petition filed by three persons among 165 candidates who could not appear in the said written test which was held after two postponements.

The recruitment was held under a notification of the DGP office issued on April 4, 2010 for filling up posts of 243 Sub-Inspectors and 49 Jamandars which was held in three stages.

A total of 1714 candidate cleared the first stage, physical efficiency test (PET).

The three petitioners in their joint petition, explained that they were unable to appear in the written test, which was initially fixed on December 19, 2010.This date was again postponed to December 31, 2010.But no written test was conducted on December 31 with reasons best known to the authority.

The candidates expected another date to be announced with wide publicity.

But at the relevant point of time, local newspapers as well as broadcasting of local cable network were suspended with effect from December 30, 2010 to January 5, 2011 due to the agitation launched by the All Manipur Working Journalists' Union against the arrest of its vice-president A Mobi Singh.

The above factual position is in conformity with the instruction issued on January 2, 2011 by the director, Manipur Police Training College, Pangei.

The instruction disclosed that "165 out of 1741 PET qualified candidates did not come to participate in the written test held on January 2, 2010". They further informed the court that the result of the written test is not yet announced and prayed the court to give a direction to the state government represented by Chief Secretary, Principal Secretary (Home), the DGP and Inspector General of Police (Chairman of DPC) for the recruitment for arranging a written test for the left out candidates.

After hearing the contention of the petitioner, the court of Justice Asok Potsangbam directed the DGP to hold a written test for the left out candidates within a period of 45 pays from the date of receipt of a certified copy of the order.

Further, the court observed that this aspect is considered by the court in view of the settled position of law that relief granted to a petitioner need not be confined to the petitioner alone as "the same shall be applicable to all the similarly situated persons and thereof, any order to be passed by this court, shall also be applicable to the remaining 165 candidates, who have not approached the court".

The order further stated till the written test is held, the result of the written test held on January 2 should not be finalized.

On the other hand, one of the petitioners has called a meeting of the 165 candidates on February 12 at 2 pm at DM College of Commerce to discuss the order of the court.
