The Gauhati High Court has issued notice of motion to the Speaker and Secretary of Manipur Legislative Assembly pertaining to an alleged illegal appointment of one post in the Assembly.
Justice UB Saha, in his Imphal bench sitting, issued the notice yesterday following a writ petition filed by two persons, Mahesh Angom and Laitoijam Romen Meetei.
The Court asked the two respondents to give their replies within four weeks said advocate M Hemchandra, appearing on behalf of the petitioners.
The petitioners challenged an order issued by the Assembly on September 25, 2006 appoin ting one K Mamata Devi as Committee Officer temporarily on regular basis.
The writ said that this order was issued arbitrarily "illegally by extending the device of favourism and nepotism, without following the required peocedure/steps for direct recruitment to a post..." .
The order was also issued during the existence of the ban on direct recruitment, it said.
The petitioners prayed before the Court to quash the September 25 order saying that the same "is bad in law and also not sustainable in the eyes of law".
In the interim, they prayed before the Court to suspend the said order till the disposal of the present petition "as the ends of justice may call for".
