Imphal, October 26 2014: The Manipur University authority has come up with a detailed clarification regarding the resolutions taken by the Executive Council on October 18 and Dean's Committee of the varsity on September 29 and October 4 this year.

A statement issued the Deputy Registrar said that as desired by the office of the Governor of Manipur and subsequent reminders over telephone, regarding charter of demands submitted by Manipur University Tribal Students' Union, the University prepared a break-up of seats for reservation of SC/ST/OBC/UR students for admission to various courses in the varsity as per the Central Educational Institutions (Reservation in Admission) Amendment Act, 2012 .

The matter was placed in the meeting of the Deans and Heads of Departments held on July 23, 2014 and the same was approved.

On the same day, the break-up figures was submitted to the office of the Governor of Manipur, the statement said and added that the University also issued a press release on July 24, 2014 notifying that the reservation of seats in admission as stipulated in the Central Educational Institutions (Reservation in Admission) Amendment Act, 2012 would be 31percent for ST, 2 percent for SC and 17 percent for OBC and the same would be implemented from 2014-15 academic session.

As there were resentment from a section of the University community on the break-up of figures for reservation of SC/ST/OBC in admission, the matter was placed in the special meeting of the Academic Council held on August 14, 2014 and the Council resolved that Central Educational Institutions (Reservation in Admission) Amendment Act, 2012 be adopted in principle in the University and be made effective from the academic year 2015-16, the statement added.

However, a PIL praying to quash and set aside the Academic Council resolution and another writ petition praying not to give effect to press release issued on July 24, were filed in the High Court of Manipur.

On September 3, 2014, the High Court not only dismissed the writ petition but also disposed off the PIL directing the Manipur University to admit students in terms of the Act as per the distribution of seats prepared by the Manipur University for the academic year 2014-15 in accordance with the amended provision in the courses where admission process has not yet been undertaken, the statement said.

Subsequently, on August 13, 2014, the Chancellor Prof Dilip M Nachane informed the University that the students had to understand that the University was only implementing an Act of the Government.

In an emergency meeting held on September 6, 2014 the Academic Council in compliance with the order of the High Court of Manipur adopted the Central Educational Institutions (Reservation in Admission) Amendment Act, 2012 along with the detailed break-up of seats for ST/SC/OBC/UR students for admission to various courses for the academic year 2014-15 for implementation with immediate effect.

However, a Review Petition No 36 of 2014 directed against the aforesaid judgment and order dated 3.9.2014 was filed in the High Court of Manipur again, the statement added.

On September 19, the Court observed that as the Court had already directed the University to admit the students in terms of the relevant Act as per distribution of seats prepared by the University for the academic year 2014-15, there is no difficulty in acting upon the prepared list if the said list prepared by the Registrar of the University has been endorsed by the Academic Council.

Again another writ petition No 753 of 2014 praying to quash/set aside the University letter dated 23.7.2014 was filed in the High Court of Manipur.

On September 24, 2014, the High Court passed an interim order which stated, "As interim measure, it is directed that if the seats are available in the subject such as Earth Science, English and Physics, one seat in each of the above three subjects shall be kept reserved" .

Subsequently, the meetings of the Deans' Committee of the University held on September 29, 2014 and October 10, 2014 noted that admission list for the Department of English and Physics incorporating reserved SC seats had already been notified and admission process was almost completed.

But for the Department of Earth Science, the Committee resolved that one SC seat be kept reserved and the candidate be admitted with the consent of the High Court.

The same resolution was endorsed by the Executive Council on October 18, 2014 .
