High Court directs

In a case pertaining to the Manipur Urban Road, Drainage and Asset Management Improvement Project (MURDAMIP), the High Court of Manipur has directed a member of the Tender of Evaluating Committee to appear before it tomorrow.
The High Court on February 12 was hearing a complaint filed by Bharatiya Infra Project Ltd against rejection of their bid for Package No 4 "Improvement of roads within Imphal city with rigid pavement including concrete lined drains" under the project MURDAMIP, funded by the Asian Development Bank.
Notably, the Bhartiya Infra Project Ltd bid was rejected on the ground of "non performance contract" in view of termination of its contract by the Railways in 2022 .
The tender for the MURDAMIP Package no 4 was floated by the Public Works Department with a contract price of Rs 531.90 crore and construction duration of 3 years (36 months) .
Only two firms made bids for the contract and AMRIL-IRCON Joint Venture's tender was successful.
Against the rejection of its bid for the contract, BIPL had then filed a complaint with the High Court.
The BIPL has claimed that its "overall performance" is not declared "non-performer" by the Railways.
It has claimed that subsequent to termination of the contract, it has been awarded contracts by the Railways.
Had the BIPL been treated as non-performer by the Railways, it would have been barred from participation in future tender processes of the Railways.
However, on the contrary, the Railways has allowed BIPL to participate in subsequent tender processes after termination of the contract, argued A Arunkumar Singh, counsel for the firm in the Court.
The Court, after hearing the submissions of the counsel, gave direction for a member of the Tender Evaluating Committee to appear before it on February 20 .
