No Parliamentary Secys in State: AG

Advocate General N Kumarjit has categorically stated that there is no Parliamentary Secretary in the State.
The High Court of Manipur today heard the petition filed by Congress MLAs Surjakurhar Okram and DD Thaisii seeking annulment of the impugned Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Act 2012 which empowered the State Government to appoint Parliamentary Secretaries.
Notably, the incumbent State Government exercising the same Act had appointed 12 Parliamentary Secretaries last year.
Whereas the writ petition filed by the two Congress MLAs was admitted in the High Court on February 14 this year, the Manipur Legislative Assembly today passed the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provisions) Repeal Bill 2018 on February 23 .

The same petition was heard today by a Division Bench of the High Court comprising of acting Chief Justice N Kotiswar and Justice Kh Nobin where Advocate General N Kumarjit who appeared on behalf of the respondents submitted a gazette notification and said that there is n6 Parliamentary Secretary in the State.
The gazette notification issued on April 4 says that the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provisions) Act 2012 has been repealed.
The repeal (of the Act) however would not affect its previous operations or anything duly done in official discharge of their duties by the Parliamentary Secretaries.
The repeal shall not affect any right, privilege or obligation incurred under the repealed Act, mentioned the notification.
Later the petitioners' counsel prayed the Court to give 10 days time to study the details of the notification and the Court granted the prayer.
The 12 MLAs who were appointed as Parliamentary Secretaries in the present Government and listed as respondents of the case are Khurai AC BJP MLA Leisangthem Susindro alias Yaima, Naoriya Pakhanglakpa BJP MLA Soibam Subhaschandra, Keirao AC BJP MLA Lourem bam Rameshwor, Kshetrigao AC BJP MLA N Indrajit, Mayang Imphal AC BJP MLA Kongkham Robindro, Yaiskul AC BJP MLA Thokchom Satyabrata, Sekmai AC BJP MLA Heikham Dingo, Konthoujam AC BJP MLA Dr Sapam Ranjan, Jiribam AC Independent MLA Ashab Uddin, Chingai AC NPF MLA Khashim Vashum, Phungyar AC NPF MLA K Leishiyo and Tamei AC NPF MLA Awangbow Newmai.
The other respondents listed in the case are the Chief Secretary and the Deputy Secretary (Law) .
