Maibam Manojkumar, Special Judge, POCSO, Imphal West, convicted one Bashir Ahmed of Kshetri Mayai Leikai for sexually assaulting a minor victim on June 10, 2014, apart from fixing December 7 for the sentence hearing.
The judgment was passed after it was kept reserved following the final hearing on October 10.Bashir Ahmed was on bail but he appeared before the Court for the hearing today with his counsel and soon after the Court convicted him, he was taken into judicial custody at Manipur Central Jail Sajiwa.
The case began against the convict from June 11, 2014 after the father of the victim lodged a complaint before the Imphal East Women PS stating that the minor was sexually assaulted by the convict the previous day (June 10) .
Based on the complaint, a regular case was registered and the convict was arrested by police soon after.
The IO of the case after the completion of the investigation submitted the charge sheet against the convict under different sections of IPC and POCSO Act.
Charge was framed on May 10, 2017 for the trial and during the trial, the Court heard the submission of 10 prosecution witnesses.
However, no witnesses were produced from the side of convict in his defense.
During the final hearing, the Special PP submitted that as per the statement of the victim, the convict took off her clothes and sexually assaulted her for around 5 minutes.
The Special PP also mentioned that the clinical laboratory examination report supported the statement of the victim as seminal stain was found in the undergarments of the victim.
On the other hand, the defense counsel of the convict contended that the medical report clearly stated that there was no evidence of sexual intercourse and prayed for acquitting Bashir Ahmed.
The Court, after going through the records, convicted Bashir Ahmed and fixed December 7 for announcing the quantum of punishment.
