Acting on a habeas corpus petition the gauhati High Court has asked the police to produce two persons who were arrested on September 13 in connection with the elopement of an MLA's daughter before the same court on September 20 morning.
Thounaojam Anouba Singh (39) and Thounaojam Premananda Singh (26) of Lamjao Makha Leikai were picked up by a team of Imphal west police without issuing arrest memo nor furnished any valid reason for the arrest on September 13, contended petitioners Leihao Devi w/o Anouba and Th Iboyaima who is the father of Premananda.
Advocate Meihoubam Rakesh, appearing on behalf of the two petitioners said the police have not produced the arrested duo before a magistrate since their arrests.
The arrested persons are being detained in the lock-up without provision of food leading to the families looking after their food need since then.
Though no FIR case has been registered on the matter the police reportedly told the families of the duo that they were arrested in connection with the elopement of the MLA's 19 year old daughter with a driver of the State legislator on September 9.Moreover, the police is informed to have told the families that Premananda and Anouba would be set free only after they disclose whereabouts of the eloping pair.
On the otherhand, based on complaint lodged by the girl's family police picked up the 26 year old driver's parents and sister-in-law with the three in judicial custody after they were remanded by a court, Rakesh said and added that as the police have failed to release Premananda and Anouba the habeas corpus case had to be filed.
Having heard both parties, the Court headed by Justice T Vaiphei and MBK Singh in their Imphal bench Division sitting today asked the SP Imphal West to produce the duo by 10.30 am of September 20.
