Man convicted for sexual assault

A 61-year old man from Imphal East has been convicted under section 5 of POCSO Act for committing sexual assault on a girl on October 8, 2017 night and fixed October 31 for sentence hearing.
A complaint was filed by the father of the minor victim at Women Police Station, Imphal East stating that on October 8 at around 9 pm, her minor daughter was crying because of pain on her private part.
On questioning, his minor daughter disclosed that she was forcibly sexually assaulted by the convict at their residential gate.
Subsequently, a case was registered.
Nambram Memtu Devi, the IO of the case, after completion of the investigation of the case submitted a charge sheet before Fast Track Special Court Number 2 on January 27, 2018 .
The Special Judge, POCSO Imphal East took cognizance of the charge sheet on May 22, 2018 against the convict and framed charges under section 6 of POCSO Act to which the convict pleaded not guilty.
The prosecution, in order to prove the charge beyond reasonable doubt, produced 11 prosecution witnesses, 20 documental exhibits and eight material objects before the Court during the trial of the case.
The Convict, on the other hand, in his defence produced three defence witnesses which included his wife and a younger brother before the Court.
During the trial of the case, the Court heard the submission of Special PP in-charge M Raichand as well as the defence counsel of the convict.
The Special PP submitted that prosecution has been able to prove the offence committed by the convict and he is liable to be punished according to law.
On the other hand, the defence counsel submitted that the prosecution has totally failed to prove the offence alleged to have been committed by the convict and that the case was framed by the prosecution in collusion with the complainant to harass the convict.
The Court, after hearing the submission of Special PP, the defence counsel and on perusal of the records placed before the Court, observed that the prosecution is able to prove beyond reasonable doubt that the convict committed the offence of sexual assault on a 4-year old minor girl at around 9 pm.
The Convict who was present during the announcement of the judgment, was remanded in Manipur Central Jail, Sajiwa with intermediate custody warrant.
The Court also directed the SP, Manipur Central Jail Sajiwa to produce the convict on October 31 for sentence hearing.
