4 cops chargesheeted in 1998 killings

The CBI has chargesheeted four police commandos including Additional SP Th Krishnatombi in connection with the alleged fake encounter/extra judicial killing of Major (Retd) Shimreingam Shaiza and four others on August 29 in 1998 .
The chargesheet was submitted before the Court of the Chief Judicial Magistrate, Imphal West by Inspector Sh Parvender Kumar of the CBI, New Delhi and who is now attached to the CBI/SIT Manipur.
Those named in the chargesheet include Additional SP Th Krishnatombi of Taobungkhok Makha Leikai, then Constable Khundongbam Inaobi of Minuthong Kabo Leikai, then Constable Thangkhongkam Lungdim of G Songgel village in Churachandpur district and then Constable Md Akhtar Hussain of Yairipok Tulihal Konjil Leikai.
Two other police personnel who are now deceased were also named in the chargesheet.
The two deceased police personnel are Ginkhanlal Vaiphei of Bethel Veng, New Lamka and Naorem Rajen of Samurou Makha Leikai.
The chargesheet was submitted in line with the directive of the Supreme Court of India passed on July 14, 2017 .
As per the chargesheet submitted by the CBI, Th Krishnatombi in a complaint lodged with Singjamei Police said that a Maruti 1000 cc car was seen coming in a very suspicious manner and the CDO team signalled the car to stop at the sight of the muzzle of a weapon.
The car however without paying any heed sped towards the airport side and the commando team gave a brief chase and the occupants from the car fired upon them hitting the vehicles of Th Krishnatombi and then Sub Inspector N Rajen.
The police team also returned fire and all the five occupants of the Maruti car received bullet injuries and three of them succumbed to their injuries at the spot and two were evacuated to then JN Hospital.
One of them however succumbed on the way to the hospital.
The complaint further alleged that two AK 47 Rifles with magazines loaded with 6 rounds each and one empty magazine were found on the rear seat by the side of two deceased persons.
However another FIR was registered at Singjamei Police Station by Pemla Shaiza wife of deceased retired Major S Shaiza.
The bereaved wife said that her husband S Shaiza along with four others including Thenucho ex-Speaker of Nagaland Assembly, Tusovihu of Nagaland Police, Kekheto Sema of Nagaland Police and Rukno Saila the driver were travelling in a car along the Imphal Airport on August 29 morning and the commando personnel had committed cold blooded murder by indiscriminately firing upon them.
The ex-Speaker of Nagaland Assembly was on his way to the Airport to catch a flight at the Major and the others were with him to drop him when they were signalled to stop by the police commandos.
As soon as the car stopped, the commando team started firing and it was then that Major Shimreingam Shaiza got down from the car shouting his name and something in Manipuri towards the police commandos but he was cut down by the bullets from the police commandos, said CBI.
During the investigation two witnesses who saw the incident stated that they were on the Airport road at Kwakeithel Akham Leikai they saw a white coloured commando Gypsy coming in very high speed and blocked the Maruti car which was not in very high speed without much effort.
Soon after that 4-5 commandos jumped out from Gypsy and started indiscriminate firing from the front side without any warning and no firing was made by the occupants of the Maruti car, said the chargesheet of the CBI.
Investigation further revealed that in the said incident Th Krishnatombi fired 4 rounds from his 9mm pistol, Kh Inaobi fired 11 rounds from his AK 47 Rifle, Thangkhongam Lungdim fired 8 rounds, Md Akhtar Hussain fired 12 rounds, expired Ginkhanlal Vaiphei fired 3 rounds and expired Naorem Rajen fired 8 rounds CBI/ SIT prayed that the accused commando personnel are liable for prosecution under section 302/307/201/34 of IPC and named then Constable Ginkhanlal Vaiphei and then SI Naorem Rajen who are no more in another column of the chargesheet.
Further investigation is on against remaining commando personnel involved in the case and prayed cognizance against them and issue notice against them.
Prosecution sanction under section 197 of CrPC against the accused persons shall be submitted to the Court as and when received from the competent authority.
