Rape convict sentenced to 2 years RI

Fast Track Special Court no.2 Manipur on Thursday sentenced one Khoisnam Ibohal - who was convicted under Section 12 of POCSO Act 2012 - to two years of rigorous imprisonment.
On Thursday, Ibohal (63) of Singjamei Thokchom Leikai was produced before the court for sentence hearing.
On June 8, the FTC court had upheld the charges levelled against him.
According to the submission made by Special PP, in view of the rising crimes agaipst young women, the court needs to set an example and send a message to the society by taking stringiest punitive measures.
The Special PP added that the convict deserves the most severe punishment.
The convict's counsel, however, argued that Ibohal did not have any criminal history and sought minimum punishment applicable under the law.
After listening to the submissions and thoroughly examining all the evidence, the court noted that the convict was 58 years old at the time of committing the crime as per the charge sheet.
The incident happened to be convict s first crime.
As per Section 12 of the POCSO Act 2012, the maximum punishment that can be awarded is three years with fine.
Accordingly, the court sentenced Khoisnam Ibohal to two years rigorous imprisonment and ordered him to pay a line of Rs 40,000, with Rs 30,000 to be awarded to the victim.
If he fails to pay the fine, he would have to serve another jail term of three months.
As per the records, the convict stayed in custody for four months and 17 days from October 7, 2020 to February 24, 2021 .
The court ordered that the custody period would be commuted from his sentence.
