Class XI question leak case: Accused remanded

Moirangthem Sunderchand, managing staff of Dineshwori Higher Secondary School, Canchipur, was remanded in judicial custody till March 14 in connection with the leakage of the question papers of the Class XI examination conducted by COHSEM, while Nameirakpam Ranjit, proprietor of New Vision Hostel, Canchipur, was released on bail after furnishing a PR bond of Rs 50,000.Mention may bee made that Moirangthem Sunderchand (33) s/o Chaoba of Kyamgei Mamang Leikai and Nameirakpam Ranjit (43) s/o Yaima of Tentha Khunjao (presently staying at Manipur University 1st gate, Canchipur) were arrested by police on February 22 and February 25 respectively.
Producing the two individuals before the CJM Imphal West, the IO of the case submitted a prayer for remanding them in judicial custody for further investigation of the case.
On the other hand, the counsels of the two individuals, filed remand objections along with prayers for bail.
The IO narrated that a regular case was registered based on a complaint lodged by the Secretary of COHSEM informing that the question papers of five subjects of Class XI Examination 2020, were circulated on social media sites and WhatsApp, which forced the Council to seek back all the question papers from the schools.
It was found that the question papers returned by Moiranthem Sunderchand, of Dineshwori Higher Secondary School, were cut opened and on questioning, he admitted to opening the sealed question papers and taking photographs, the IO explained.
Further, during the course of investigation, he revealed that he sent the photos via Bluetooth to one Nameirakpam Sumila w/o Nameirakpam Ranjit, who is the proprietor of New Vision Hostel, Canchipur.
The investigating team, along with women police, rushed to the said location to seize all possible evidence and in the process, police seized a mobile phone belonging to Sumila.
The police also instructed her to appear before the investigating team the next day, but she failed to do so and every possible means to contact her were in vain.
Furthermore, it was found that the leaked questions were also propagated by one juvenile who is appearing the examination and on questioning the juvenile, he revealed that on the evening of February 15, Sumila sent the English question papers from her mobile phone to him through WhatsApp while he was in the hostel.
Later, on the morning of February 18, Sumila again sent question papers of four subjects to him through WhatsApp and told him that the question papers were provided by Sunderchand and instructed him not to disclose the question papers to anyone.
The IO continued that on February 22, at around 9.30 pm, Sumila and her elder sister, along with some people, went to the residence of the juvenile and confronted him regarding the leakage of the question papers.
The IO also alleged that the juvenile was instructed by Sumila to claim that he took the copy of the question papers without her knowledge or consent if interrogated by police.
Due to such revelation, an immediate search was conducted again for arresting Sumila but police could not find her anywhere.
The following day, police arrested Sumila's husband, Nameirakpam Ranjit and seized his mobile phone due to suspicion of being involved in the crime as well and in threatening the juvenile.
Citing all the facts of the investigation, the IO prayed for remanding the two individuals in judicial custody.
After going through the case records and hearing the submission of both the IO and the counsels, the Court remanded Moiranthem Sunderchand into judicial custody till March 14.The Court, however, granted bail to Ranjit and ordered him to be released after furnishing a PR bond of Rs 50,000 and a surety of the same amount.
On the other hand, Session Judge, Imphal West, issued interim bail to Nameirakpam Sumila after she executed a PR bond of Rs 50,000.The Court also fixed March 7 for report and hearing of her anticipatory bail.
