Rape case : Court convicts man

The Court of Special Judge, POCSO Senapati, on Thursday, convicted a 48 year old man under Section 6 of POCSO Act for sexually assaulting his own daughter several times in 2022 .
The next hearing will be held on May 12 to announce the quantum of punishment.
The convict is from Senapati district.
The case was initiated against the convict following a complaint lodged on March 16, 2022 by a member of a Childline, alleging that the convict had sexually assaulted the minor victim multiple times since February 2022 .
During custodial interrogation, the convict admitted that he is a habitual drunkard and stated that he could not recall whether he had assaulted his daughter.
He also revealed that another criminal case is pending against him at Senapati police station for attempting to kill his father with a firearm, for which he had served one year in Manipur Central Jail, Sajiwa.
Upon completion of the investigation, D Pounai, SubInspector of Senapati Women police station submitted the charge sheet against the convict for trial.
On September 25, 2024, a charge under Section 6 of the POCSO Act was framed against the convict for the commission of aggravated penetrative sexual assault on the victim.
The convict pleaded not guilty and claimed trial.
During the trial, the prosecution produced 14 witnesses, 16 documents, and 7 material exhibits to prove the charges beyond reasonable doubt.
During the hearing, Koshia Mao, Special Public Prosecutor for the State, submitted that the convict is the father of the minor victim and had been assaulting her since his wife left him due to his drinking habits.
After considering the submissions of the Special Public Prosecutor, the defence counsel, and on perusal of the oral and documentary evidence presented by the prosecution, the Court observed that the prosecution had established the convict's guilt beyond reasonable doubt.
In light of the findings, the Court concluded that the prosecution successfully proved that the convict committed aggravated penetrative sexual assault on the minor victim and therefore convicted him under Section 6 of the POCSO Act.
The Court scheduled May 12 for the sentencing hearing.
