Court sacks Sheristadar

Imphal, August 18 2015: The District and Sessions Court, Imphal East and the disci-plinary authority concerned yesterday passed an order to remove Sheristadar ZV Shainotla from her post for manipulating her date of birth in the service book and con-cealment of her HSLC pass certificate.

She was put under suspension for some time before she was finally removed from the post.

ZV Shainotla was working in the erstwhile District and Sessions Court, Manipur East, now known as District and Sessions Court, Imphal East.

The order was passed by District and Sessions Court, Imphal East Judge A Gune-shwar Sharma and discipli- nary authority concerned.

An enquiry was initiated against ZV Shainotla on April 6, 2015 after two complaints were filed against her by six of her subordinate judiciary staff on December 11 and 15 last year.

In their complaints, they accused Shainotla of entering her date of birth wrongly in the service book and refusing to produce HSLC pass certificate, which normally verifies date of birth of employees.

The complaints said that when ZV Shainotla was serving as a Sheristadar in the District and Sessions Court, Manipur East, she mentioned March 1, 1954 as her date of birth instead of March 1, 1956 .

As such, she should have retired on February 28, 2014.Later, she also refused to produce her matriculation certificate from where her exact date of birth could be ascertained.

Following the complaints, an enquiry committee was constituted with Chief Judicial Magistrate, Imphal East A Noutuneshwari Devi as the enquiry officer and Judicial Magistrate First Class/Civil Judge (Junior Division), Imphal East N Lanlemi as the presenting officer on April 6, 2015 .

LDC Ng Tenny appeared as defence official/assistant in the enquiry proceedings.

In spite of giving ample opportunities during the course of enquiry, ZV Shainotla failed to produce her matriculation certificate after which an employee of District and Sessions Court, Imphal West was sent to Guwahati to collect her records from Board of Secondary Education, Assam.

ZV Shainotla appeared in Class X examination conducted by the Board in 1972 under roll number 1329 (Imphal) .

On June 8, 2015, A Noutuneshwari received a fax message from the Academic Officer of BOSEA stating that the date of birth and result of passing provided by ZV Shainotla were false.

After the Enquiry Officer submitted a report on June 15 stating that ZV Shainotla had altered her date of birth.

On June 16, ZV Shainotla was given an opportunity to give her reply regarding the finding of the enquiry report including the subsequent development of possessing of fake matriculation certificate and asked to submit her reply before June 30 .

In her reply, ZV Shainotla alleged that the verification report dated 8/6/2015 issued by BOSEA was manipulated.

However, she failed to submit the original pass certificate of HSLC examination, which was in her procession since November 13, 2014 .

Although, ample opportunities were given, ZV Shainotla could not produce any document or witnesses in her defence except for mere denial of the enquiry report.

As such, District and Sessions Court, Imphal East ordered removal of ZV Shainotla from her service with immediate effect and her application dated June 10 seeking permission to retire voluntarily has been rejected as its acceptance would amount to regularizing her entire service through fake certificate.

The Court order also mentioned that she may approach appropriate authority within 30 days from the date of the receipt of the order.
