NHRC directs hand over of Brajamani killing case to CBI

Not pleased with the report of the Magisterial Enquiry conducted by Additional District Magistrate, Imphal West Manipur in connection with the alleged encounter killing of one Angom Brajamani s/o Phayeng Makha Leikai by Manipur Police Commandos in 2007, NHRC has directed the State and India Governments to transfer the investigation of the case to an Independent Agency like CBI.
Mentioned may be made that Brajamani alias Tomba was killed in an alleged encounter by Imphal West Commandos at Khuyathong Pukhri Achouba Mapal, on November 18, 2007.Status report of police investigation revealed that Brajamani was a cadre of PREPAK.
Following the incident, NHRC directed the state government to conduct a magisterial enquiry into the incident to find out the truth behind the killing.
Accordingly, the state government conducted a magisterial enquiry and the state Home Department submitted the report of the enquiry to NHRC on June 16, 2011. As per the report of the enquiry, it was stated that Brajamani was killed in a real encounter by Imphal West Commandos.
After studying the enquiry report and the negligence of the state government who did not ordered an enquiry in the first instance, the NHRC did not find the report convincing.
NHRC also pointed out that the Magistrate never summoned the brother of the slain person who identified the victim during the enquiry.
Moreover, the enquiry report does not indicate whether the deceased had criminal history or not and concluded that the enquiry report cannot be taken as a safe guide and directed the state government and Centre to give their concurrence for CBI investigation of the case and communicate the same to the Commission within two months.
