Nasir's case : CJM rejects police report

Chief Judicial Magistrate, Imphal East today rejected the final report (FR) submitted by the OC of Porompat Police Station seeking disposal of an assault case filed against Agriculture and Fisheries Minister Abdul Nasir and his personal security officer (PSO) .
After perusing the final report, CJM Imphal East A Noutuneshwari directed the OC to re-investigate the case as per law and submit a fresh report within three months.
It may be mentioned that one Alam Azad of Yairipok Ningthounai lodged a written complaint at around 8.30 pm of November 26, 2012 at Porompat Police Station stating that the Minister and his PSO assaulted him at a NEFSA food stall in Manipur Sangai Festival at around 7.30 pm the same day.
Following the complaint, the Court took up a case under Cril Misc case number 101 of 2014 with reference to the FIR number 499(11)2012 of Poromopat Police Station under Section 325/427/34 Indian Penal Code and 27(1-C) Arms Act.
During his statement examination before the Court, Alam Azad objected to the disposal of the case.
Taking cognisance of the final report of the police and the statement given by the victim, the Court observed that the FIR filed by Investigation Officer (IO) appeared to have no sign of a proper investigation.
In the decree passed today, the Court questioned why the investigating authorities failed to book and produce the culprits before the Court if the complainant fully corroborated with the OE.
The order questioned how the IO had changed the section of law to Section 323 IPC from Section 325/427/34 IPC and 27 (1-C) Arms Act.
After considering all the aspects of the case, the plea for the disposal of FR was turned down by the Court and the OC of Porompat Police Station directed to re-investigate the case and submit a fresh report within three months to the Court.
It may be mentioned that Alam Azad's complaint mentioned that the incident happened at NEFSA food stall of Manipur Sangai Festival on November 20, 2012 .
He stated that Minister Abdul Nasir and his security escort team came to the food stall and assaulted him using abusive language in front of a large crowd.
Alam also alleged that Minister's PSO pulled out a pistol and put it on Alam's forehead while other escort personnel hit him on his head.
During the assault, Alam said, he fell on the ground and the Minister's escort dragged him around the food stall.
After Minister and his team left the spot, he was rushed to JNIMS Hospital for treatment, Alam Azad said in his complaint submitted to the police.
