10 years RI for rape convict

The Court of Fast Track Special Court number 2 Manipur Special Judge Ch Brajachand on Friday sentenced a rape convict to 10 years of rigorous imprisonment.
The Court also directed the State Government to provide Rs 7 lakh to the victim as a compensation.
Convict Ngairangbam Bhubaneshwor (28), s/o Rajen of Khurai Lairik-yengbam Leikai was convic- ted by the same Court on February 17 .
The convict is married and has two children.
The Court heard the submission of Special PP T Bipinchandra and defence counsel during the sentence hearing.
The Special PP submitted that the convict was found guilty for the offence u/s 451 IPC and Section 6 of POCSO Act.
It is also submitted that the crime committed by the convict was gruesome and prayed for maximum punishment.
On the other hand, the defence counsel argued that the convict was only 21 years when he committed the crime and he has been in custody from August 2017 upto December 2018.He was again sent to custody in April 2022 and has been staying in custody since then.
It was also submitted that the convict is a first time offender while praying for minimum punishment.
The Court after hearing both the Special PP and defence counsel and considering the entire facts and circumstances of the case sent the convict to 10 years of rigorous imprisonment.
The convict has also been directed to pay a fine of Rs 3 thousand and in default of payment of the fine he has to undergo simple imprisonment of three more months.
The Court further ruled that the convict has to undergo simple imprisonment of additional two years under Section 415 .
The Court said that the two sentences against the convict shall run concurrently and the period he had spent in custody during the trial and investigation of the case was set off.
The case was on against the convict after a complaint was lodged by the mother of the victim stating that her daughter was raped on August 24, 2017 .
Saying that she went out to look for her daughter as she did not return home from school on that day at around 1 pm, the complainant continued that she met one unknown person coming out from her house while she was returning home.
The complainant further stated she rushed inside her house on seeing the unknown person and saw her daughter/victim crying on bed naked with blood on her private part and redness on her neck.
She went on to state that she couldn't find the unknown person when she hurried outside but managed to identify him as Nagairangbam Bhubaneshwor with the help of local youths.
