Acting on a writ petition filed against the torture and inhuman treatment meted out to an innocent goldsmith by personnel of Moirang police station for two days continuously, the Gauhati High Court, Imphal Bench has issued a notice of motion returnable within six weeks.
The notice of motion was issued by Justice UB Saha following a writ petition filed by the victim Moirangthem Gandhi (24) s/o M Tombi of Moirang Ngangkha Lawai Awang Leikai, conveyed Human Rights Law Network in a press hand-out.
According to the petitioner's counsel Meihoubam Rakesh, M Gandhi was picked up personnel of Moirang PS at about 12.05 pm of April 15 this year from his home.
At the police station, Gandhi was subjected to severe torture for two days without providing any food or water.
At about 3.30 pm of April 17, Gandhi fainted.
Subsequently, he was taken to Moirang CHC from where he was referred to RIMS Imphal.
But the police personnel who took him to Moirang CHC left him there instead of taking him to RIMS.
Later, the victim of police atrocity was taken to RIMS by his own family members.
Admitted to RIMS on April 17, Gandhi underwent surgical operation of a serious nature before he was finally discharged on August 8.Yet, Gandhi still needs constant medical treatment at home, said Rakesh.
Even as Moirangthem Chaoba, elder sister of Gandhi, submitted a written complaint to SP Bishnupur district on April 25, no tangible action was initiated, said the counsel.
Contending that the very act of the police personnel amounted to violation of the right to life enshrined in the Article 21 of the Constitution of India, Rakesh demaned punishment of the errant police personnel and adequate compensation to the victim.
The respondents listed in the case include Principal Secretary (Home), the DGP, SP Bishnupur district and the OC of Moirang PS, it mentioned.
