Every offence committed under the ND & PS Act. i.e. Narcotic Drugs, Psychotropic Substance and controlled substance are being tried by the special court ND & PS, Manipur located at Lamphel.
This is a pivotal Court for the state of Manipur in as much as our State is the paradise of drug smmugglers and drug peddlers. Since some years ago the State has been facing problems transit traffic in illicit drugs.
The spill over from such traffic has caused countless problems of drug abuse and addiction. Many undeterred public organisations such as Meira paibi and local clubs struggling to annihilate such illicit drugs from the soil of Manipur.
The State Police and other department of Central Government including para military forces apprehended many drug offenders.
A large number of drug cases including recent Colonel involving case are still pending in the Special Court ND&PS Manipur. Many accused are languishing inside the jail.
It is very unfortunate that at this crucial moment there is no judge for the Special Court ND & PS Manipur.
We need a powerful judge for the Special Court ND & PS Manipur, as early as possible to prick the bubble of the drugs racket.
Every judge says "No guilty person will be spared" but sometimes their passion can't be fulfilled because every trial is a voyage of discovery in which truth is the quest.
The conviction of a person for a crime depend on the evidence adduced by the prosecution during the trial.
So a good charge sheet without loopholes and lacuna is needed and it should be proved before the Court under the Indian Evidence Act.
If the prosecution has failed to prove the case beyond reasonable doubt, benefit of doubt goes to the accused.
So all the investigating agencies should remember that an extempore charge sheet is as useless as the Moon in the day time.
Sometimes Court is blamed by the common people and even by the top brass as they don’t fully comprehend the provisions of the ND & PS Act.
The Apex Court reiterated that "harsher the law, stricter vigilance by the Court is required" or in other words "severer the punishment, greater the care to be taken to see that all the safe guards provided in the statute are scrupulously followed".
In conclusion, my judgement is that Court and police only can't wipe out the drug dealers because there are many veiled dignitaries behind the drug drama.
