Tales Of 2 Interests: Plagiarists telling not to Infringe Copy Right

THANK God! Finally, we saturated our resolution of the FGD's agenda as 'Copy Right doesn't protect ideas, titles and names'; otherwise, the infringements list-of-the-persons would be too long.
To put in a closing stage of the academia-puja on that day, akin to legal pundits, some from us hymned the whole mantras of intellectual property Right, by ruling-out that 'ideas' can be protected after fixing it to a tangible, visible, or audible forms, and room of registration are also provided, and it can be carried out, under Section 45 of the CR Act-1957, which is not compulsory but optional coz' some real legal pundits have wrote that a work of a person is copy-righted from the moment when it is fixed in tangible forms.
It was the day, some yrs back, just after our coach facilitates her session on Media Laws; a focus group discussion (FGD) among students was turned into a brewing focus-group-debate, over the topic of Copy Rights Laws. Few mates of mine, who methinks, wannabe's media-stalwarts and the self-styled university proud-studs flaunted their modest knowledge that was gleaned from our big library, which has a limited edition of books.
Indeed best, those were the days, even though we battled everyday of wits, to get more marks, on teacher's assignment. And the theory, used by the majority is identical, was known as 'Reproduction through CTRL + C & CTRL + V', in short we understood as 'copy-and-paste theory'.
Most did, and followed the above same theory from dot com spheres, for the assignments given by the teachers, in such a way to be not suspected and to leave no clues of the usages of such theory, nevertheless majority of them are caught, and the teacher underlined with a red-pen and wrote a term that reads 'Last Warning'.
Thank God! Really thanks that I didn't follow the crowd, and subsequently the moment I recounted and pondered, seemingly it rung truth that 'every secret would be known, every crime would be punished'----- that's what the cruel sister Annie readings of the New Testament, in the exasperating morning-assembly, of the missionary institute I schooled before I reached the senior secondary level.
Well, gone are the days but memories still remained loving. And, what Meseems is, the Copy Right Act is not only a law but it can also be seen as a moralistic-science for denizens, in which it reinforces moral principle of a creative individual or society, that wrongful appropriation of someone's asset (art, literature, music) or misappropriation or pilfering someone's masterpiece or hard work is wrong in all sense, removing someone's apostrophe without his or her consent or acknowledgement, and apostrophizing after your name falls under the territory of burglary or a thief, more or less with a same difference.
Other reason, Methinks of it as a moral science, is that it seems to build a morale that promotes morality to greater strive for genuine creativity, encouraging greater productivity for society as a whole, in such a way allowing the creator/inventor to own a fame or a fortune of his efforts given and to protect it, too.
But on the flipside of it, 'Tales of Two Interests' happens; the first being the creative interest of a person to plagiarize from someone's work and to produce his own, and other being the interest of the same person to protect his product that build his creative foundation through Plagiarism. Isn't this a tale of two interests, a plagiarist telling not to infringe his copy right.
For good and all, let's don't name the persons and let's don't pin point his masterpiece, coz' we all know it, heard it, seen it, too. So, let's tagged it them as, 'Naam Hain stylist-Plagiarist, Kaam Hain Breach!'
If, copy right infringement is punishable by law, then plagiarism is also a 'breach of ethics' of every creative bylaw?
It's a mass-hyped subject, by the International RIGHTIVIST, that Copy Right comes under the banner of Intellectual Property Rights (commonly known as IP Right), which is considered as a fundamental right of by international community and, an extension of freedom of speech and expression by many International legal consultants . IP Rights significantly played a significant role in the globalised Industrial economy, which TRIPs (trade-related aspect of IP Right) constitute an important... to be concluded tomorrow segment of the four major types of IP Rights: Patent (for inventions); Copy Right (for materials); Trade Mark and Design (for Products.)
Coming closer to home, the presently enacted CR Act received the presidential accent on June 1957, after the amendment of the former CR Act of 1914; to provide, and to protect, the proprietary rights of a creator/inventor of a work that allow to earn both fame & fortune. It also provides validity of copy righted material (for literary works, Films, broadcast or telecast, etc). Beside this, its Section 63 of the Act prescribes punishment for the copy right infringement, and its flexibility of using a copy righted material.
But, OMG! What is happening here, Plagiarists telling not to infringe the Copy Right? Is the case of Plagiarism involves no liability for copy right infringement? Isn't this Plagiarism a crime per se, if it's not, then it's a moral offence and breach of ethics. So let's call those as 'Naam Hain stylist-Plagiarist, Kaam Hain Breach!'
Today, we have seen, heard, and known that many HACKERVIST around us are hacking someone's lines of ideas, thoughts, publications, etc. It's known to us that many west-music tunes, sounding are Hindinize, many stories of south Indians films and its songs are localize, and even many background scores of Hollywood's films being Vernacularise? Should we, ups our thumbs to their masterpiece, which are in reality 'Naam Hain stylist-Plagiarist, Kaam Hain Breach!'
Isn't it a breach of ethics? I feel I'm being cheated when I am exposed to a product (Film, songs or Literay Publications) that are manufactured through Plagiarism? Is Plagiarism an inspiration to begin, an innovation or motivation to create something new? Is it rooted down in the history of mankind, as I have come across cases like, a Roman poet Martial, complained that another poet had "kidnapped his verses." And, the term 'Plagiarism is believed to be introduced into English in 1601 by dramatist Ben Jonson, to describe as a plagiary someone guilty of literary theft.
If you use, without giving reasonable and appropriate credit to or acknowledgment to the author or source, of another person's original work, whether such work is made up of code, formulas, ideas, language, research, strategies, writing or other form, then you belong to those 'Naam Hain stylist-Plagiarist, Kaam Hain Breach!'
