Court orders to conduct enquiry on killing man by Commandos last year

Imphal, November 10 2009: A ruling of the Gauhati High Court, Imphal Bench today ordered to conduct an enquiry into the killing of a youth by the police commandos at Kameng Yengoubung under Lamshang police station on November 4 last year (2008) and submit a report to the court within six month period.

One Nongmaithem Micheal son of N Jayentakumar of Keishampat Keisham Leikai was killed by the commandos of Imphal west district police at Kameng Yenkoubung at about 4 pm on November 4 last year in what said to be in encounter.

Police had claimed recovery of a China make hand grenade from the slain Micheal.

Wife of the deceased Micheal, Nongmaithem ongbi Mina filed a petition to the court alleging her husband was killed in extra judicial manner and arrest the police commandos involved in the killing of her husband and takes up action under the law to award appropriate punishment.

The criminal writ petition was filed against the Principal Secretary (home), DGP and Imphal West SP.

The hearing of the case was conducted today in the court of judges comprising the Justice Maibam BK Singh and Justice AC Upadhyay of the Gauhati High Court, Imphal Bench The court also asked both the petitioner and respondent to appear in the court of district session judge, Imphal east at 10.30 am of November 23 and submit affidavits with regard to the case.

Advocate, Khaidem Mani was the counsel of the petitioner.

In the writ petition, Mina, wife of Micheal stated that her husband went out to attain a sharda ceremony of one of his friend at Keishampat Mutum Leikai on that day.

He left his friend's house at about 3 pm on received of a phone call.

At about 3.30 pm, her husband over mobile phone informed her that he has been arrested by the police commandos from Wahengbam Leikai urging to contact police for taking out him.

While, family members are considering what to do and contacted him on his mobile phone, none picked up the phone.

At last an unknown man picked up the phone and informed that he was in toilet.

But later in the news broadcasted at 9 pm of the ISTV, it was reported killed in encounter with the police commandos.

The news was confirmed after family member visited RIMS morgue where the dead body kept.

in the petition, it was also stated that in the FIR case registered in connection with the killing of her husband, it is stated that Micheal was killed when police commandos on frisking and checking duty fired at when three person on a motorcycle in suspicion manner refused to stop defying the order to do so.

The youths fired towards the police and he was killed in the retaliatory action of the police.

Police also charged him as an activist of KCP(MC) .
