The Gauhati High Court, Imphal Bench on Thursday issued show-cause notice returnable within four weeks to the Union Ministry of Defense and Assam Rifles authority to submit reply to the killing of seven youths in an alleged fake encounter.
The court passed the order after hearing a petition filed by the mother of one of the victims of the seven youths killed by the troops of 28 Assam Rifles at Andro Sanapat area in the intervening night of October 31 and November 1, 2009 .
In her petition, Oinam Keinahanbi charged that Assam Rifles had fabricated a fake encounter in killing her son Oinam Anand and her nephew Oinam Maipakshana of Ishikha Mayai Leikai of Imphal east district along with five other youths at Andro Sanapat under Yairipok police station of Thoubal district.
Her son and nephew were rounded up from their respective houses before being killed in the stage managed encounter on the intervening night of October 22 and 23.Families lodged a complaint with the SP of Imphal east district on the next day.
In response to the complaint, the SP issued a message to the Cos of Assam Rifles and OCs of his jurisdiction asking them if Anand and Maipaksana were picked up or were handed over to the police.
Her elder brother also lodged another complaint with the Heingang police station October 31, Keinatombi stated in her petition.
The Assam Rifles fabricated a fake encounter at Andro Sanapat area in the intervening night of October 31 and November 1, 2009 and killed Anand and Maipaksana with other five unknown youths.
The AR submitted a false report with the Yairipok Police Station that they had killed seven UGs in an encounter.
The very act of the 28 AR personnel and that of the responsible police officers amount to violation of right to life enshrined in the Article 21 of Indian Constitution of India, the petitioner prayed the court for justice.
The respondent of the case GOC 57 Mountain Division, commanding officer of 28 Assam Rifles, Principal Secretary (Home) Manipur government, Director General of police, Manipur, SPs of Imphal east district and Thoubal district.
Mention may be made, a total of seven youths were gunned down by the troops of 28 Assam Rifles last night near the foothills of Andro Khunou Sanapat about 11 Km North of Yairipok police station in what they claimed to be in encounter with a group of militants.
They also claimed recovery of several sophisticated arms and ammunitions and explosives from the possession of deceased.
