N Khaiba case Session Judge sends case transfer plea to HC

Imphal, November 13 2019:
Session Judge, Imphal East, has sent an application to the High Court of Manipur to transfer the alleged fake encounter/extra judicial killing case of Ningthoujam Khaiba (November 13, 2006) to another competent Court for the necessary trial.
The accused cops, then Havildar Khundongbam Inaobi s/o Kullo of Yairipok, then Head Constable Thounaojam Herojit s/o Shyamsunder of Lamdeng Awang Leikai and then Constable Longjam Chingkheihunba s/o (L) Yaima of Keishamthong Longjam Leirak, who were charge sheeted by the CBI/ SIT in connection with Khaiba's death, appeared before the Court with their respective counsels for the charge hearing today.
During the proceeding, the defense counsels prayed for transferring the case to another competent Court as the Judge (of Session Court Imphal East) happened to be an inquiry officer of the same case based on a directive of the Imphal Bench, Guwahati High Court.
The counsels submitted that as per the directive, a judicial inquiry was conducted by then District and Session Court, Manipur East, in 2010 and during that time, the present Session Judge of Imphal East was then in-charge of the District and Session Court, Manipur East, as the inquiry officer.
