Subject: Inquiry on ‘SCHOOL VAN AMA PUKHRIDA TASINBADA ANGANG 21 ROM SIRAMGADOURE’
Sir/ Madam,
The Manipur Commission for Protection of Child Rights (MCPCR) is a statutory body empowered by the Commission for Protection of Child Rights Acts (CPCR Act), 2005 to monitor the entitlement of rights and safeguard for children provided in the Constitution and laws of the country and u/s 13 (1)(j) to inquire into complaints and take suo moto notice of matter relating to deprivation and violation of Child Rights; non-implementation of laws providing for protection and development of children and non-compliance of policy decisions, guidelines or instructions aimed at mitigating hardships to and ensuring welfare of the children and to provide relief to such children.
2. The Commission has taken cognizance of the news report published in the Manipur Daily ‘Hueiyen Lanpao’ dated 5th May, 2017 under the caption ‘SCHOOL VAN AMA PUKHRIDA TASINBADA ANGANG 21 ROM SIRAMGADOURE’. (21 children almost got killed after their school Van fell into a pond).
3. You are, therefore, requested to look into the incident and furnish the status report of spot inquiry along with authenticated copies of relevant documents to the office of Manipur Commission for Protection of Child Rights within 10 (Ten) days from the date of issue of this letter. The report should contain the following:
a) Whether the driver and the van are registered under ALL MANIPUR SCHOOL STUDENTS TRANSPORTER ASSOCIATION or not.
b) Whether regular verification of license and the condition of the van which determine the fitness of the vehicle to transport the school children is made or not.
c) To check the reason for negligence of the driver.
d) To question the driver for overloading of children in the school van (21 children as reported), which is against the norms of the Transport Department instruction.
e) Any expense to meet for treatment of the victim children should be solely borne by the driver or the van owner.
4. Pertaining to the frequent occurrence of such unfortunate accidents such as fainting of children inside their school van, driving without valid licence, using unfit vehicle for transporting school children, overloading of children beyond seat capacity, frequent changing of van drivers without the consent of parents and school authority, etc. the Manipur Commission for Protection of Child Rights (MCPCR) is deeply concerned and hence, requesting you to kindly conduct regular check up of all the buses and vans which are used as means for transporting school children for their best safeguard.
Periodic feedback reports from the school authority, student, bus/van owners for compliance of the Notification No. 12/1/2014-T(MV) dated 14th September, 2015 issued by the Secretariat Transport Department, Manipur should also be made available to the Commission regularly.
