BJP MLAs – Kh Joykishan and Th Bishwajit – have been released by the Court citing lack of evidence regarding the charges levelled against them today.
They were arrested by the police for allegedly leading an agitation at Pangei yesterday.
Chief Judicial Magistrate, Imphal East passed an order to release them after the IO of the case submitted a final report (FR) of yesterday's incident under Section 173 CrPC.
Charges under Section 147/149/151/353 IPC were earlier levelled against them for holding a protest and trying to storm Manipur Police Training Centre (MPTC), Pangei to disrupt the fresh recruitment of Manipur police Constables.
The same Court remanded the law makers to judicial custody till September 13 after they refused to furnish PR bonds yesterday.
Today's Court order mentioned that an FR was submitted by the IO of the case under Section 173 CrPC for the disposal of the case taken up against the two MLAs with respect to the FIR lodged against them at Heingang police station.
The IO in his report stated that during the investigation of the case, he had not only examined the complainant and a good number of witnesses but also visited and inspected the spot and prepared a rough sketch of the incident site with index.
The Court order further said that the two MLAs had submitted that the present State Government is acting against the wish of the masses.
As such, they along with the people tried to disrupt the fresh recruitment held at MPTC, Pangei.
After hearing the APP of the State and IO of the case and perusing the material on record including the case dairy as produced by the IO, the Court observed that there was insufficient evidence to level charges under Section 147/149/151/353 IPC against the two MLAs.
As such, Kh Joykishan and Th Bishwajit were discharged from the case and the case disposed.
