SC disposes SLP against MLA Lokeshwar

The Supreme Court of India has disposed a special leave petition filed against Congress MLA Thokchom Lokeshwar of Khundrakpam assembly constituency by BJP candidate Thangjam Mohendro in connection with the 2017 state assembly elections.
The BJP candidate filed the petition against a judgment of the High Court of Manipur.
During hearing of the petition on Monday, the apex court observed that the term of the House which was subsisting as on the date when the impugned order of the High Court was passed has come to an end.
Elections were subsequently held and the House was constituted afresh in April, 2022."The respondent has been re-elected to the House and the petitioner is stated to have initiated a fresh election petition, which is pending before the High Court of Manipur.
In that circumstance, we do not propose to go into the merits of the rival contentions," the apex court observed.
However, all contentions which are enumerated in the fresh election petition are left open to be considered by the High Court independently, the apex court observed while disposing of the petition along with all pending applications.
