NIA court directs medical board to screen Samarjit

Special Judge (NIA) Manipur on Saturday directed the directorate of health services to constitute a state medical board and assess the health condition of Narengbam Samarjit, who is in NIA custody, and to submit a report by February 18.The court conducted hearing of a bail plea filed on medical ground by Narengbam Samarjit stating that he is suffering from hypertension, heart condition, diabetes, kidney Stone and depression for which he underwent treatment in the MI room of the jail and JN1MS multiple times.
His counsel applied for his bail on medical ground stating that the accused person requires intensive medical care in a health facility outside the MI room of the jail.
On the Other hand, the special public prosecutor (NIA), in his submission, stated that this is the third time the accused has applied for bail.
The first plea was rejected by the same court on September 22, 2021 with the remark that there are material evidences to prove the charges against him.
The court again rejected the second bail plea on December 31, 2021 .
The accused could have approached the high court to challenge the court's order but he is applying the same plea to the court again with the intention of delaying the proceedings, maintained the NIA counsel.
The special PP further stated that the report submitted by the medical officer of Sajiwa jail on January 27 this year did not mention any similar past medical history.
Besides, none of the doctors who are treating him gave any advice to undergo treatment in any special medical facility.
The January 27 report of the medical officer of Sajiwa jail was not backed by any medical test reports and the MO is not qualified to give such observations since the MO is just a general medical practitioner.
After hearing both sides, the court observed that some of the health conditions mentioned in the report could be fatal for somebody and directed the directorate of health services to constitute a state medical board to assess the health condition of the accused person and to submit a report by February 18 .
