5-yr RI for man convicted in murder bid case

Imphal, April 01 2023: The court of District and Sessions Judge, Imphal West on Friday sentenced one Md Abdur Rahman (36), who was convicted of attempted murder under various sections of IPC, to 5 years of rigorous imprisonment.

During the sentence hearing held in the court of District and Sessions Judge, Imphal West Rk Memcha, the court declared Md Abdur Rahman s/o (L) Fazur Rahman of Sora Mamang Leikai, guilty under sections 307 (attempt to murder), 326 (voluntarily causing grievous hurt by dangerous weapons) and 394 (voluntarily causing hurt in committing robbery) of IPC.

The court also discharged an accused, Md Qutubuddin Khan, from the case.

In the hearing, the public prosecutor made an appeal to the court for giving stringent punishment to the convict as per the law and set an example for the society.

The defence counsel submitted to the court that the convict is now 41-year-old and is a father to one daughter and three sons.

When the convict was in judicial custody during the trial his wife returned to her parental home with his two sons.

His other son (14yrs) is living with his (convict) elderly mother, while his daughter has married.

Apart from being a minor, his son is in depression and the family in poor financial state.

The incident, which occurred on April 6, 2018, happened under the influence of intoxicants.

The convict is remorseful of his actions and wants to return to mainstream.

As he has been in judicial custody since April 13, 2018, the defence counsel appealed to the court to commute the time spent in judicial custody from his total sentence period.

After listening to the submissions, the court sentenced the convict to 5 years of rigorous imprisonment under Section 307 of IPC and asked to pay a fine of Rs 10,000; and another 5 years of rigorous imprisonment under Section 326 of IPC and to pay a fine of Rs 5000.In case of failing to pay the fines, he will serve another two months in jail.

It further sentenced the convict to 5 years in jail under Section 394 of IPC and to pay a fine of Rs 5000, failing which he has to stay in jail for two more months.

He is to serve the sentences concurrently and he can pay the fine altogether or separately.

The court also ordered that the time the convict had spent in judicial custody during the investigation and trial of the case from April 13, 2018 till the day of the hearing will be commuted from the sentences under Section 428 of CrPC and as such, he will stay in jail till April 12 this year.

If he fails to pay the fines imposed, he will stay in jail for two more months till June 12 .
