Office of Profit of 12 MLAs: SC to dispose case on Jul 26

Imphal, July 06 2021: The Supreme Court has fixed July 26, 2021 for disposing the disqualification case of 12 MLAs, who were appointed as Parliamentary Secretaries and holding office of profit.

The date was fixed on Monday after hearing the case filed by Congress MLA DD Thaisii as a petitioner against Election Commission of India and other SLP filed before the Court.

The hearing was held before the bench comprising Justice L Nageswara Rao and Justice Aniruddha Bose.

It may be mentioned that the Congress MLA filed a writ petition before the Supreme Court to give its opinion to the Governor of Manipur on the disqualification of the 12 MLAs.

The Supreme Court also issued notice to the Election Commission of India on this matter in February.

The ECI responded in favour of the 12 MLAs who were facing disqualification.

After hearing a petition filed by Congress MLAs Surjakumar Okram and DD Thaisii, the High Court of Manipur passed a judgement on September 18, 2020, stating that the Manipur Parliamentary Secretary (Appointment, Salary and Allowances & Miscellaneous Provision) Act 2012 and the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Repealing Act 2018 are unconstitutional.

The High Court also stated that the Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provision) Repealing Act 2018 was invalid.

The 12 MLAs who were appointed as Parliamentary Secretaries are L Susindro (Khurai AC), N Indrajit (Kshetrigao AC), L Rameshwor (Keirao AC), Th Satyabrata (Yaiskul AC), H Dingo (Sekmai AC), Dr S Ranjan (Konthoujam AC), S Subashchandra (Naoriya Pakhanglakpa AC), K Robindro (Mayang Imphal AC), Leishiyo Keishing (Phungyar AC), Khasim Vashum (Chingai AC), Awangbow Newmai (Tamei AC) and Asab Uddin (Jiribam AC) .
