Imphal, August 29 2009: Imphal city police has an FIR registered a separate case with regard to the killing of Ch Sanjit in alleged fake encounter by the police commandos on July 23 at Khwairamband Market following directive of the High Court but source said the investigation into the case is yet to start.

Meanwhile, with the constitution of the Commission of Inquiry with retired justice PG Agarwal, a former Judge of the Gauhati High Court to inquire into the July 23 firing incident, the Magisterial Inquiry constituted to inquire into the same case has been recalled by an order of the state home department issued today.

The City police station registered the FIR case on August 26 with regard to the killing of Ch Sanjit based on the complaint lodged by his mother, Ch Talatombi as directed by the Gauhati High Court, Imphal Bench on August 25 under FIR no.82(8)09under section 302/34 of IPC and 27 (3) Armed Amendment Act of the City Police Station.

Sub-inspector Kh Dilipkumar of the city police station will investigate into the case as investigation officer, the source said today.

The high court directed the Officer-in-Charge (OC) of City Police Station to register an FIR case on the killing of former underground, Ch Sanjit as per complaint lodged by the mother of slain Ch Sanjit, who alleged that her son was killed after arrest by the Manipur Police Commandos.

Mother of the slain youth Sanjit Ch Taratombi lodged a complaint with the OC of City PS on August 7 alleging that her son was killed by personnel of Manipur Police Commandos on July 23 after his arrest on BT Road in "fake encounter" based on the report with photograph published in newsmagazine, Tehelka August first week issue.

Source also said that the police is yet to take the statement of the complainer, Ch Talatombi even though the case has been registered apart from not initiating the investigation.

The registration of the case is above the earlier case under FIR no.75(7)09 of the City PS under section 302/326/307/506 IPC 17/20 (UA-B) Amendment act 25(1)-B Arms Act taken up by the police station in connection with the July 23 shooting incident.

No arrest with regard to the case was made so far by the police but summoning of people for taking statements have been taken up.

However, the require procedure of providing the case details to the Judicial Magisterial First Class, Imphal is yet to furnish.

The furnishing of the details is needed for magistrate to know what the case is saying and what did police do with regard to the incident.

On the other hand, subsequent upon the constitution of the Commission of Inquiry into the July 23 shooting incident headed by retired Justice, PG Agarwal, a former Judge of the Gauhati High Court to inquire into the said firing incident, with the opinion that there may not be necessary to continue the said inquiry by the District Magistrate, Imphal West has recalled the order issued on August 1 last with immediate effect, an order of the additional secretary (home), M Yaiskul today.

In exercise of the powers conferred by-section 3 of the Commission of Inquiry Act, 1952 (60 of 1952), the state government appointed a One-Man Commission of Inquiry to be presided over by Justice (retired) PG Agarwal of the Gauhati High Court to enquire into the circumsntaces leading the firing incident in which Chungkham Sanjit of Khurai Sajor Leikai, a member of the ban organisaiton PLA and Thokchom Ongbi Robina of Lamshang Bazar, Lamdeng Khunour, were killed and cuasing bullet injury to five others- Wangkheimayum Gitarani (40) wife of late Nongyai, Golmei Mangal Rongmei (59) son of G Lemba Rongmei of Mahakabui Nameihing Keithelmanbi, New Cachar road, Ningthoujam Kishorani (43) wife of N Ragumani of Narankonjin, Pangambam Lukhoi (30) son of late Pakchao of Heingang Makha Leikai and Kangabam Subhachandra (40) son of K Shamungou of Kha Potshangbam on July 23 at/around BT raod at Imphal.
