HC directs State to reply on non-appointment of Brinda

Imphal, February 19 2013: A candidate, who has cleared Manipur Manipur Civil Service Combined Competitive Examination-2010 conducted by Manipur Public Service Commission (MPSC) and subsequently offered the letter of appointment to the post of MPS, has filed a case in Gauhati High Court for not allowing to join the post.

Accordingly after hearing of the case, Gauhati High Court has instructed the authorities concerned to give appropriate answers in this regard by March 7 next.

The order of the Gauhati High Court, Imphal Bench came following a petition filed by RK Ongbi Thounaojam Brinda against the Chief Secretary and the Secretary of Department of Personal and Administrative Reforms, Government of Manipur.

According to the order passed by Justice T Veiphei of Gauhati High Court, Imphal Bench, the government advocate should take instructions from the State Government on whether a person involved in a criminal case can be recruited in a Government job or not and to submit the report by March 7.It also ordered to conduct the hearing of the case on the same day, i.e on March 7 itself.

According to the petition filed by Brinda, she cleared the preliminary, the main and the interview of Manipur Civil Service Combined Competitive Examination-2010 conducted by MPSC.

Accordingly, she received the letter of appointment for the post of MPS which she accepted October 1, 2012 .

However, an office memorandum issued by the Department of Personnel and Administrative Reforms, Government of Manipur, stated that she (Brinda) is married to RK Chinglen, s/o RK Meghen alaias Sanayaima, who is the Chairman of the proscribed UNLF and that she is also involved in a criminal case.

Again, a report filed by CID (Special Branch), stated that at the time of arrest of RK Meghen by NIA in November 2010, Brinda along with her mother-in-law and other family members openly showed solidarity and support to her father-in-law, indicating her sympathy towards UNLF.

It further stated that if Brinda is appointed as an MPS officer in the Manipur Police, she will be in a position to disclose and compromise the programmes and policies of the department if she so desires and considering her sympathy and closeness to RK Meghen, it is likely to make the department highly vulnerable to the designs of UNLF.

And therefore she is not fit to be appointed as an MPS officer in the Home Department, Government of Manipur.

In her petition, Brinda contested that the office memorandum of the Department of Personal and Administrative Reforms, Government of Manipur issued on January 10, 2013 is against the law of the land.

The FIR on alleged criminal case in which she was involved too had been withdrawn.

As such, the order of the Office memorandum should be termed null and void and she should be appointed as an MPS officer.
