Court rejects bail to man accused of attempted murder

Imphal, May 08 2021: Chief Judicial Magistrate Imphal West rejected a bail application filed by attempted murder accused Nelson Nameirakpam (33) .

Nelson Nameirakpam is being charged with attempt to murder one Roshan Thounaojam on March 13, 2020 at Horizon Printing Shop owned by the accused located at Lamphel Supermarket.

Two bail applications were filed in the Court, one by the accused and the other by his father.

During the hearing, the defense counsel submitted that the charges levelled against the accused (Nelson) are quite "false and fictitious" and further submitted that on the day of incident, Roshan Thounaojam (32) of Thangal Bazar came to the shop of the accused and they both went up stair to smoke.

They had a casual conversation regarding their personnel affairs and later ensued an argument and altercation using harsh words.

Further altercation led to physical scuffle among them.

Both of them fell down the wooden stair and suddenly, Roshan allegedly tried to shoot the accused by suing a small gun.

The accused never attempted to assault or kill his friend (Roshan) .

The accused used a sharp paper cutter knife which was lying nearby to defend himself, claimed the defense counsel.

On the other hand, the bail objection filed by police mentioned that during the police custody interrogation, the accused disclosed that out of anger he picked up a cutter which was lying on the floor and cut the neck of the victim and as a result, the victim was bleeding.

As soon as he noticed, he held the victim and went out to evacuate him to the hospital for treatment.

The Court after hearing the submissions, observed that the accused actually committed the heinous crime of attempt to murder.

The nature of injury caused to the victim is serious as it was and by the grace of God, the victim survived the deadly attack.

The Court mentioned that a charge sheet has been submitted on April 30 and the trial against the accused is likely to commence very soon before the Court of Session Judge.

The Court then rejected both the bail applications and remanded Nelson to judicial custody until further orders.
