Imphal, September 18, 2009: Unhappy over the inordinate delayed of the CBI to file chargesheets against the then Deputy Commissioner of Ukhrul Pankaj Kumar Pal and to arrest the accomplices of Hopeson Ningshen, the main accused in the case of abduction and subsequent murder of Dr Thingnam Kishan and his two subordinate staff, the JAC Against the Killing of Dr Kishan, Yumnam Token and Aribam Rajen has stated that it been left with no alternative but to file a case in the court of CJM Ukhrul in this regard.

Issuing a statement detailing the updates of the triple murder case, JAC chairman S Tikendrajit Singh lamented that the CBI is yet to file chargesheets against the accused persons inspite of the assurance given by Ganesh Verma, SP, CBI, Imphal and IO of the case to do the needful within a month's time in response to a recent inquiry.

This inordinate delayed in submission of chargesheet by the CBI and the failure of arresting the accomplices of Hopeson Ningshen has prompted two local clubs, namely Thangmeiband United Club and Thangmeiband (TUC) & Uripok United Clubs' Organisation (TUCO) to send rejoinders to the IO but to no avail.

The case of CBI's transfer petition of the subject case from the court of CJM Ukhrul to any court of competent Magistrate/Special CBI courts in Delhi, to which the JAC had already contested, was taken up by Supreme Court on August 10 and September 14.The case would be heard next on November 24, the JAC statement informed, adding that the case of transfer has not been challenged by the respondents, Hopeson Ningshen and his lawyers.

Meanwhile, the JAC went on to convey, victim-families have submitted an application to the court praying to allow the applicants to intervene in the present transfer petition, pass any such further or other order(s) as the court may deem fit and proper in the facts and circumstances of the case.

In case of allowing the present transfer petition, the victims' families have also prayed the court to direct the petitioners (CBI) to bring two representatives of each of the deceased to Delhi at the cost of the State/petitioner to represent the victims during the trial at Delhi and if the transfer petition is not allowed then to direct the State to bear the cost of legal representation on behalf of the victims.

The JAC further informed that informations regarding the findings of the Committee constituted by the orders of the Governor, Manipur relating to the triple killing case have been sought under RTI Act.

But the Home Department, Government of Manipur has turned down the request citing sub-section 1 (h) of Section 8 of RTI Act, 2005.Moreover, similar application under RTI Act seeking informations regarding the present state of suspension and whereabouts of Pankaj Kumar Pal has also not been entertained by the Department of Personnel quoting sub-section (g) and (h) of Section 8.Nonetheless, the case is now being put up to the State Information Commission for his orders, the JAC disclosed.

The negative response by the investigating agency to legally proceed against Pankaj has left no alternative but to file a case in the court of CJM, Ukhrul for directing the OC, PS Ukhrul to register an FIR against Pankaj Kumar Pal, the JAC added.
